Intellectual Property and Takedown Policy

How to report content that infringes your rights, and how we respond.

Last updated

Tryso respects intellectual property rights and expects its customers to do the same. This policy explains how to report content on Tryso or a store hosted on it that infringes your copyright, trade mark or other rights, and how we respond. It is designed to satisfy notice-and-takedown procedures under the US Digital Millennium Copyright Act (17 U.S.C. § 512), the EU Digital Services Act, the Sri Lanka Intellectual Property Act No. 36 of 2003 and similar laws.

1. Submitting a notice

Send a notice to [email protected] with the subject "IP notice" including:

  1. your name, address, phone and email, and, if you act for the rights holder, your authority to do so;
  2. a description of the work, trade mark or right you say is infringed (with registration numbers where relevant);
  3. the exact URLs of the content, product listings or domain complained of;
  4. a statement that you have a good-faith belief that the use is not authorised by the rights holder, its agent or the law;
  5. a statement that the information in your notice is accurate and, under penalty of perjury where applicable, that you are the rights holder or authorised to act for them; and
  6. your physical or electronic signature.

Incomplete notices may delay our response. Knowingly false notices can make you liable for damages.

2. What we do

  1. We review the notice promptly and, where it is complete and credible, remove or disable access to the content, or require the store owner to do so.
  2. We tell the affected organization and send it a copy of the notice (we may remove personal contact details if you ask).
  3. The store is the publisher of its content; we act as a hosting provider and do not decide the merits of disputes between rights holders and stores.

3. Counter-notice

If your content was removed and you believe that was a mistake or that you have the right to use it, send a counter-notice to [email protected] containing: your contact details; identification of the removed content and where it appeared; a statement, under penalty of perjury where applicable, that you believe in good faith it was removed by mistake or misidentification; your consent to the jurisdiction of the courts of your address (or, outside the US, of Colombo, Sri Lanka) and to accept service from the complainant; and your signature. We forward it to the complainant and may restore the content after 10–14 business days unless they tell us they have started legal proceedings.

4. Repeat infringers

We close organizations or storefronts that repeatedly infringe others' rights in appropriate circumstances.

5. Our own marks

"Tryso", the Tryso logo and the product names in the Service are our trade marks. You may refer to Tryso accurately (for example "powered by Tryso"), but may not use our marks in a way that suggests endorsement, or as part of your own product, company or domain name.

Sri Lanka supplement

These terms apply in addition to the sections above for customers and users in Sri Lanka. Where they conflict, this supplement prevails.

Sri Lanka: Intellectual Property Act

Rights in copyright, related rights, trade marks, industrial designs and geographical indications in Sri Lanka are governed by the Intellectual Property Act No. 36 of 2003. Registered trade marks and designs are administered by the National Intellectual Property Office of Sri Lanka. When you send a notice about a Sri Lankan registered mark or design, include the registration number.

Sri Lanka: court proceedings

Civil proceedings for infringement in Sri Lanka are heard by the Commercial High Court of the Western Province (Colombo). If a complainant tells us they have started proceedings, we will keep the content disabled until the court decides or the parties settle. We comply with injunctions and enjoining orders of Sri Lankan courts.
